Everyone who agrees to the following "up2us" terms and conditions is welcome to visit and contribute to the "up2us" Internet website <http://www.up2us.ca> ("Site") on the World Wide Web. Please review these terms and conditions carefully prior to using this Site as these govern any and all use of the Site. By browsing, accessing, or using this Site, you agree that you have read, understand, and are bound by the terms and conditions outlined below. If you do not agree to these terms then do not use this Site.

We reserve the right to change, amend, add or remove parts of these terms and conditions at any time. If you continue to use the Site after changes to the terms and conditions have been posted, it means you have accepted the new terms and conditions.

Content, Ownership, Use Restrictions
The information contained in this Site including all images, illustrations, designs, photographs, videoclips, writings and other materials may be copyrights, trademarks, and/or intellectual property (all of which, collectively, are herein referred to as the "Contents") owned, controlled, or licensed by "up2us".

The name "up2us" and the "up2us" logo have been developed and are owned by the Annapolis Valley-Hants Community Action Program for Children (AVH-CAPC). Everything you see or read on this Site is either owned by "up2us" or used with permission. If you use material from this Site, do not accept credit for producing the material yourself - this could - for example - result in violation of intellectual property rights and subject you to civil or criminal penalties.

Comments, Feedback, Postings,
and other Submissions
Before submitting anything to this Site, you agree that "up2us" can use this material at its discretion. All submissions will be subject to posting and therefore we ask that you not submit information you consider to be confidential.

"up2us" will not be responsible for the safe-keeping of any submissions sent to them. Further, "up2us" shall not be obligated once a submission is accepted to notify the author with respect to any reproduction, use, disclosure, and distribution of the same. "up2us"will however be free to use or share submissions and transmissions with others without limitation. Additionally, "up2us" shall be free to use any ideas, concepts, knowledge, or techniques contained in such information for any purpose whatsoever including, but not limited to, developing, manufacturing, or marketing products incorporating such information. Further you agree that "up2us" may use information regarding your demographics and use of this Site in any manner that does not reveal your personal identity.

Users of this Site are put on notice and agree to the following: You are prohibited from posting or transmitting to or from this Site any unlawful, threatening, libelous, offensive, slanderous, inflammatory, pornographic, or profane material or any other material that could give rise to any civil or criminal liability under law. Contributors are solely responsible for the content of any comments they make; this Site does not hold any responsibility for the remarks of others. However, let it be known that should postings or transmissions be considered unlawful, threatening, libelous, offensive, slanderous, inflammatory, pornographic, or profane by the owners/operators of this Site, they will remove the material and/or take action as is deemed appropriate.

Appropriate Online Conduct and Content
Anytime, with the exception of private e-mail, you upload to, distribute content, or publish through "up2us", you grant us the right to edit, copy, remove, distribute, and create derivative works from the original submission and publish such content in any form and/or medium, whether electronically or in hard copy and whether alone or as part of a collective work. You shall retain, however, whatever other rights you have in pre-owned elements of such content.

All areas on the Site are public and not for private communications. Chats, postings, conferences, and other communications by users are not endorsed by us and such communications shall not be considered reviewed, screened or approved by us. We reserve the right for any reason to remove without notice any contents of the Site received from a user, including without limitation, message board postings.

The Site may contain hyperlinks to websites operated by parties other than us. Such hyperlinks are provided for reference and convenience only. We do not control such websites, and are not responsible for their contents. Do not assume that because we have hyperlinks to such websites that we endorse any of the material on such websites or have any association with their operators.

You are entirely responsible and liable for all of your activities on "up2us". Listed below are examples of violations that may result in your access to this Site being banned. For a more complete listing please see the "up2us" Acceptable Use Policy (AUP).

  1. Post, transmit, promote, or distribute content that is illegal.
  2. Harass, threaten, embarrass, or engage in any other activities that are unwanted by another member or user of this Site. This means: insulting them, repeatedly sending them unwanted messages, attacking their race, heritage, gender, sexual preference, etc.
  3. Transmit or facilitate distribution of content that is libelous, harmful, threatening, harassing, abusive, racially or ethnically offensive, vulgar, sexually explicit, obscene, offensive, slanderous or objectionable in any reasonable person's view.
  4. Disrupt the flow of chat areas with vulgar language, abusiveness, or other conduct that may disrupt normal activities.
  5. Pretend to be someone you are not. You may not impersonate another member, an "up2us" staff member, or anyone else.
  6. Attempt to obtain a password, account information, or other private information from a member, or collect e-mail addresses or other information.
  7. Post any unsolicited advertising, promotional materials, or any other forms of solicitation. We reserve the right to remove content at any time, including any content that violates these standards. We are not responsible for any objectionable material you may encounter while using the Site, particularly content found through links to other websites.

Users Under 13
If you are under 13 we require that you ask your parents for permission prior to sending any personal information to "up2us" or to anyone else. Your safety is of utmost importance and part of ensuring that is through letting your parents know what you are doing on the Internet. As with all users at "up2us", we assure you that we do not rent or sell personal information about any of our users.

Disclaimer of Liability
AT NO TIME AND UNDER NO CIRCUMSTANCES SHALL "UP2US" BE LIABLE FOR SPECIAL, INDIRECT, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO, LOSS OF USE, DATA, OR PROFITS, WITHOUT REGARD TO THE FORM OF ANY ACTION, INCLUDING BUT NOT LIMITED TO CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTIONS, ALL ARISING OUT OF OR IN CONNECTION WITH THE USE, COPYING, OR DISPLAY OF THE CONTENTS OF THIS SITE.

"up2us" and those who helped us create, produce, deliver, or maintain this Site are not liable for any damages that may result from your use of the Site. This includes direct, incidental, consequential, indirect, or punitive damages and solicitors' fees arising from your access to, or use of, the Site, including but not limited to challenges or actions for infringement, libel, and slander.
